Welcome to Root & Crown Trimming Services ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

1. Definitions

In these Terms:

• "Services" refers to all garden trimming, pruning, root care, and related services offered by Root & Crown.
• "Client" or "You" means the individual or entity receiving our Services.
• "Contract" means the agreement for Services between Root & Crown and the Client.
• "Website" refers to www.rootandcrown.in and all associated pages.
• "Content" means all text, images, videos, and other materials available through our Services.

2. Service Agreement

2.1 Scope of Services

We provide professional garden trimming and related services as described on our Website. Specific services will be detailed in a written estimate or contract provided to you before work begins.

2.2 Estimates

All estimates are valid for 30 days from the date provided. Final pricing may vary based on actual conditions found during on-site assessment.

2.3 Service Limitations

Our Services are subject to:

• Weather conditions and other force majeure events
• Accessibility of the work area
• Local regulations and tree protection laws
• Plant health and safety considerations

3. Client Responsibilities

3.1 Access and Preparation

You agree to:

• Provide safe, unobstructed access to all work areas
• Remove or secure pets during service visits
• Disclose any known hazards (bee hives, unstable trees, etc.)
• Obtain any necessary permits or approvals from local authorities

3.2 Property Boundaries

You warrant that all work requested is within your property boundaries. If we incur costs due to incorrect boundary information, you agree to reimburse these costs.

3.3 Underground Utilities

You must inform us of any underground utilities (sprinklers, cables, pipes) before root work begins. We are not liable for damage to unmarked utilities.

4. Payments and Fees

4.1 Pricing Structure

Our fees may be based on:

• Hourly rates (₹1,500-₹2,500 per hour depending on service)
• Per-project fixed pricing
• Per-unit pricing (per tree, per linear meter, etc.)

4.2 Payment Terms

Unless otherwise agreed:

• Residential services require 50% deposit upon booking
• Balance is due upon completion of services
• Commercial accounts net 15 days from invoice date

4.3 Late Payments

Payments overdue by more than 30 days will incur a monthly late fee of 1.5% or the maximum allowed by law, whichever is less.

5. Cancellation and Rescheduling

5.1 Client Cancellations

Cancellation policies:

• More than 48 hours notice: Full deposit refund
• 24-48 hours notice: 50% deposit retained
• Less than 24 hours notice: Full deposit retained

5.2 Weather Delays

We may reschedule services due to unsafe weather conditions (heavy rain, high winds, extreme heat) at no charge to you.

5.3 Company Cancellations

We reserve the right to cancel contracts if:

• The work area is unsafe
• Required access is denied
• Client misrepresents the scope of work

6. Warranties and Guarantees

6.1 Workmanship Guarantee

We guarantee all work for 30 days from service date. If you're unsatisfied, we'll correct the issue at no additional cost.

6.2 Plant Health

While we take utmost care, we cannot guarantee:

• Recovery of previously unhealthy plants
• Flowering or fruiting results
• Growth rates after trimming

6.3 Limitation of Liability

Our total liability for any claim related to our Services is limited to the amount you paid for those specific Services. We are not liable for:

• Pre-existing plant conditions
• Damage from weather events after service
• Acts of third parties

7. Intellectual Property

7.1 Website Content

All content on our Website is owned by Root & Crown and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our permission.

7.2 Before/After Photos

We may photograph your property before and after Services. You grant us a perpetual license to use these images for marketing purposes, though we will never disclose your address without consent.

8. Dispute Resolution

8.1 Good Faith Negotiation

Both parties agree to attempt resolving disputes through good faith negotiations for at least 30 days before pursuing other remedies.

8.2 Mediation

If negotiation fails, disputes will be submitted to mediation in Bengaluru, Karnataka before pursuing litigation.

8.3 Governing Law

These Terms are governed by the laws of India. Any legal actions must be filed in courts located in Bengaluru, Karnataka.

9. General Provisions

9.1 Entire Agreement

These Terms, along with any written estimates or contracts, constitute the entire agreement between you and Root & Crown.

9.2 Amendments

We may update these Terms periodically. Continued use of our Services after changes constitutes acceptance of the new Terms.

9.3 Severability

If any provision of these Terms is found invalid, the remaining provisions will remain in full effect.

9.4 Waiver

Our failure to enforce any right under these Terms does not constitute a waiver of that right.

9.5 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to any successor or affiliate.
